HOW LONG WILL IT TAKE TO GET MY DRIVING PRIVILEGES BACK IN AKRON, OHIO?

This is one of the first questions people ask me when they first talk to me. It is a completely understandable question based on how much is at stake in a DUI/OVI case. If this is your first DUI offense you have lost your license administratively for 90 days, with a minimum period of 15 days before you can obtain privileges.

If you provided a breath test over .17, or refused the breath test, you have lost your license for a year, with a minimum period of 30 days before you can obtain privileges. For second, third, and fourth offenses the period is even longer.

Two weeks, and certainly a month, is a long time to wait to drive – especially if you you are in jeopardy of losing your job because of it. Fortunately, there are methods to appeal the mandatory minimum periods that you have to face.

The first is an ALS (Administrative License Suspension) Appeal – that needs to be filed within 5 days of your arrest/arraignment. The second is a motion to stay the ALS.

The appeal, if successful, is better because it completely removes the administrative suspension from your case.

The stay is still a good result because it gives you the ability to drive right away. However, if you eventually lose your case you might still have to face the suspension period.

HOW DOES AN AKRON DUI ATTORNEY GET DRIVING PRIVILEGES FOR THEIR CLIENTS?

As I stated above there are a couple of different ways to obtain privileges and it differs from court to court. It is important that you hire a DUI Attorney in Akron that knows the difference between the courts in the area because each court, and each judge, can require different procedures.

For example, one judge in the area will allow the attorney to obtain privileges merely by asking for them orally. Another judge requires that the attorney file specific paperwork that raises certain defenses. And yet there is another judge that will not even consider driving privileges while the case is pending.

WHAT HAPPENS IF YOU GET CAUGHT DRIVING WITH A SUSPENDED LICENSE?

It is important that if you have been arrested for an alleged DUI/OVI that you not drive until you obtain driving privileges, or your license back. If you are caught driving outside of your privileges, or without them, you will be charged with a new crime – driving under suspension.

This crime carries with it all types of extra problems, penalties, and possible fines/incarceration. On top of that, it will not be conducive to the prosecutor wanting to show mercy, or the Judge to show leniency.
