It is tough to find an attorney that handles DUI cases and knows what they are doing. Some of these attorneys will claim that they can handle your DUI/OVI case but really have no idea what they are handling other than perhaps knowing the basics (such as mandatory jail time on even a first offense, or that you can go to jail for six months.) One way to spot someone that is not really a DUI attorney is to ask this question: “What is your fee? And what can I expect for that fee?”
This question should more or less end the conversation, or debate, over whether or not the attorne you are talking to is a DUI attorney. DUI attorneys know that these cases are incredibly complex, and while they are not slam dunks for the government, they take a tremendous amount of work to win. For a DUI attorney’s clients it is worth the work – they have a career where a DUI will end it, they need to avoid jail, or they do not want the embarassment of having a DUI on their record.
Some attorneys charge $750.00 for their work – and when asked they typically will say something like “I will go into court with you and argue for the best deal possible.” They might look at a police report, or they might look at a video. But realistically they will not be putting the hours in, necessary, to defend you. Ask if this fee gets you all the way through trial – ask them when they will file your motion to suppress evidence and why that is important to your case.
